Liability Waiver & Photo Release Agreement

1. Assumption of Risk & Waiver of Liability

I acknowledge that my participation in any activity offered by Kyle Lam Sound Healing (including but not limited to yoga, meditation, breathwork, sound healing, dance, Reiki, and related workshops or ceremonies) is entirely voluntary and undertaken at my own risk⁠.

I am fully aware that these activities involve physical, emotional, and psychological exertion and may expose me to the risk of serious injury, illness, trauma, emotional distress, or even death. These risks may arise from my actions or inactions, the actions or inactions of others, facility conditions, equipment use, or unforeseen external factors.

By participating, I voluntarily assume all known and unknown risks. I waive, release, and discharge Kyle Lam Sound Healing, its founder Kyle Lam, all team members, affiliates, contractors, volunteers, staff, representatives, agents, heirs, and successors (hereafter collectively referred to as “Released Parties”) from any claims, liabilities, demands, causes of action, or damages that may arise out of or relate to my participation, including travel to and from the event.

This includes, but is not limited to:

  • Personal or bodily injury
  • Emotional or psychological harm
  • Illness or disease (including communicable illnesses)
  • Property damage or loss
  • Economic, reputational, or psychological damage

This release applies even in cases of negligence—whether active or passive—on the part of the Released Parties, to the fullest extent allowed by law.

2. No Medical or Therapeutic Representation

I understand that all events and services offered by Kyle Lam Sound Healing are intended solely for personal and spiritual exploration⁠, and are not a substitute for medical, psychological, or therapeutic advice or treatment. I confirm that I am solely responsible for my physical, mental, and emotional well-being before, during, and after participating.

3. Indemnification and Financial Responsibility

I agree to indemnify, defend, and hold harmless the Released Parties from any losses, claims, suits, liabilities, costs, damages, or expenses (including attorney’s fees) resulting from:

  • My participation in any activity hosted by Kyle Lam Sound Healing
  • My actions, misconduct, or negligence
  • My failure to follow instructions or event guidelines
  • Any claims brought by a third party on my behalf or related to my actions

If I damage any equipment, space, or property, whether intentionally or through negligence, I accept full financial responsibility for the repair or replacement costs.

4. Medical Emergencies

If I require medical attention during an event, I authorize Kyle Lam Sound Healing to seek necessary treatment. I understand that:

  • I am solely responsible for the full cost of any medical services or transport.
  • Kyle Lam Sound Healing is not liable for any outcomes related to emergency assistance or lack thereof.
  • Participation while under the influence of alcohol, drugs, or any substance that impairs awareness is strictly prohibited.

5. Group Tickets & Minor Participants

If I am purchasing tickets for other individuals, I confirm that:

  • I am authorized to accept this agreement on their behalf.
  • I will inform them of these terms in full.
  • I assume responsibility for their conduct and any resulting liability.

If the participant is under 18 years of age⁠, I confirm that I am their parent or legal guardian and consent to the terms of this agreement on their behalf.

6. Conduct & Event Integrity

Kyle Lam Sound Healing reserves the right to refuse entry or remove any participant without refund if their behavior is:

  • Disruptive
  • Aggressive
  • Disrespectful
  • Unsafe to themselves or others
  • In violation of the sacred and respectful nature of the event

Participants removed for conduct reasons forfeit all rights to refunds or credits.

7. Defamation & Brand Integrity

I agree not to engage in any behavior, online or in person, that:

  • Defames, slanders, or falsely discredits Kyle Lam Sound Healing
  • Intentionally disrupts the experience for others
  • Seeks to damage the reputation, integrity, or business operations of the organization

I understand that such behavior may result in immediate removal, legal action, and permanent exclusion from future events.

8. Photo, Video & Media Release

I grant Kyle Lam Sound Healing the unrestricted right to photograph, film, and record my participation in this event. I authorize the use of my image, voice, and likeness in any format—including digital, print, and online media—for marketing, documentation, or educational purposes.

I waive any:

  • Right to review or approve final content
  • Right to royalties or compensation
  • Claim to the ownership of such materials

All media becomes the property of Kyle Lam Sound Healing and may be edited, repurposed, or distributed without further notice.

9. Limitation of Liability

In the unlikely event that Kyle Lam Sound Healing is found legally liable for any reason, I agree that the maximum liability shall not exceed the amount paid for my ticket or participation.

10. Governing Law & Jurisdiction

This agreement shall be governed by and construed by the laws of the State of California, USA⁠. Any legal dispute shall be resolved exclusively in the courts located in California, and I waive any objection based on venue or jurisdiction.

11. Final Acknowledgment

I affirm that I have read this Liability Waiver & Photo Release in full. I understand and accept all terms voluntarily and without coercion. This agreement is binding upon me, my heirs, representatives, assigns, and legal guardians.
